Facilities Rental/Usage Agreement and Guidelines
All classes and group meetings must be HIV/AIDS beneficial. (Submission of curriculum and/or group description may be required prior to approval.) Space is available on a first come first serve basis only. The rental fee is for usage of the space and may or may not include set-up for special needs or requirements.

FEES

100% of any space rental fee paid goes directly to Being Alive to support the many valuable programs and services provided to people living with HIV/AIDS.

Transferability:
The right to use the premises is not transferable.

For-Profit Organizations:

Non-Profit Organizations:
NON-PROFIT HIV/AIDS ORGANIZATIONS: The room rental fee will be waived for charitable 501(c) (3) HIV/AIDS organizations.

The room rental fee may be waived for other non-profit organizations at the discretion of Being Alive and Priority Pharmacy. Proof of 501(c) (3) status may be required.

Support Groups or any other "repetitive weekly" meetings that seek a fee waiver must be held during regular business hours M-F (9:00am-6:00pm). Exceptions may be allowed with prior approval.

All organizations must comply with all aspects of this agreement as well as the following rules. Renter must notify the Learning Center contact person 24 hours in advance if the rented space is not going to be used on the scheduled/reserved date.

Being Alive and Priority Pharmacy reserve the right to decline facility rental/usage to any group or organization.

Credit Cards – We cannot accept American Express. Contact the Being Alive finance manager for Credit card payments.

SPACE USAGE POLICY
General Information:
1. The Being Alive Learning Center (BALC) and Priority Pharmacy reserve the right to determine appropriate usage of facilities and space for public/private events.
2. The BALC large classroom is not available for rental during regular pharmacy business hours; 9:00am-6:00pm (M-F) 10am-2pm (SAT).
3. The rental fee is for usage of the space and may or may not include set-up for special needs or requirements.
4. The Renter understands that art displays, furnishings and other displays in the BALC shall not be touched, removed, covered or altered in any way except with permission in advance of the event from the BALC staff and Priority Pharmacy management.
5. BALC and/or Priority Pharmacy personnel must be present at any event or meeting.

Conditions of Rental:
Rental/usage of the BALC Class Rooms and/or Private Offices only includes the specified areas.

Restroom facilities are available during the rental/usage period. The restroom is handicap accessible.

No security deposit is required; however, guests are expected to return the rental space to the condition in which they found it before their event began. If excessive cleaning or repairs are necessary following an event, an additional charge will apply. BALC reserves the right to revoke rental/usage privileges at any time.

All rental fees must be paid seven (7) days prior to the event, unless there is prior written agreement to do otherwise. The room rental fees paid will not be refunded unless a cancellation occurs more than three (3) days prior to the date of the event.

Usage hours reflect actual hours in which Renter has access to the BALC areas.

Event RSVP’s are the responsibility of the presenter unless other arrangements are made when reserving the space.

A Being Alive San Diego program evaluation form must be provided to all participants at the conclusion of the event and returned to the onsite coordinator. Copies will be provided to the presenter if requested.

Clean-up Responsibility
Renter agrees to leave all BALC facilities in the same condition as when the Renter/User took possession. If excessive cleaning or repairs are necessary following the event, an additional charge will be levied. BALC reserves the right to revoke rental/usage privileges at any time.
GENERAL GUIDELINES AND RESPONSIBILITIES
Catering
Catering is not supplied by either Being Alive nor Priority Pharmacy for any events scheduled at the BALC. The Renter is solely responsible for the catering of any food or beverage.

Beverages
Beverages distributed or offered for sampling must be at no charge. Alcohol is not allowed without prior approval from Being Alive and Priority Pharmacy.

Smoking
Smoking is not allowed on the premises. This includes in all rooms and on the patio of the BALC. Smoking is allowed only on the sidewalk.

Drug Possession or Use
Possession or use of illegal drugs of any kind are not allowed on the grounds. The San Diego Police Department will be called if any illegal drugs are used, found, or suspected on any individual on the premises of the BALC.

Security
Certain events may require security. The Renter is solely responsible for scheduling and payment of security personnel for the duration of such events. Please check with Being Alive or Priority Pharmacy to see if your event requires security.

Parking
BALC cannot guarantee nor secure or reserve any parking areas in the surrounding parking lots. Parking is available on the street or in paid parking lots in the neighborhood. Parking fees, fines, tickets, etc. are not reimbursable. Complimentary parking is available in “Priority Pharmacy” reserved spaces located behind and to the side of the BALC from the hours of 9:00am-6:00pm M-F and Saturday from 10:00am-2:00pm. Only spots numbers 1-8 are allotted to Priority Pharmacy. The lot is patrolled by a private company 24 hours a day, and violators are at risk for receiving a ticket if they have not either parked in those designated spots or have not paid the attendant. In the instance that spots 1-8 are taken and the guest does not want to pay private lot's fee, they are welcome to park street side. Contact the BALC for complimentary evening hour parking availability.

Obstruction and Damage
Sidewalks, entrances, hallways, stairs or elevator to the BALC shall not be obstructed or caused to be obstructed by Renter or guests, nor is it permitted that these be used for any purpose other than entrance and exits to the BALC.

Recording, Broadcasting, and Camera Usage
No event presented at the BALC may be broadcast, video taped, recorded or otherwise reproduced without the written consent of Being Alive and/or Priority Pharmacy. Renter must present permission from all parties involved before permission is granted. In the event that consent is granted, Renter shall ensure that BALC and its staff receive proper credit. “Recorded live at the Being Alive Learning Center at Priority Pharmacy in San Diego, CA”

Lost or Stolen Articles
BALC shall have the sole right to collect and have possession of articles left in BALC. Where lost articles can positively be identified by the rightful owner, BALC and Priority staff will make every effort to reunite such articles with the rightful owner. Neither Being Alive nor Priority Pharmacy will be held responsible for any articles lost or stolen at an event.

Storage
BALC will not accept any shipped goods.

Animals/Pets
Animals, other than those required by persons with disabilities, or those required by a physician's order, will not be allowed in the BALC offices or Class Rooms during scheduled events/meetings. Animals/pets are allowed in the BALC during regular pharmacy business hours when the animal/pet’s owner is present.

Lodging
The BALC will not permit any person to stay overnight in the BALC facilities.

Insurance
Neither Being Alive nor Priority Pharmacy nor Being Alive Learning Center’s insurance will protect either the Renter or the Renter’s guests, employees, agents, servants or caterer from claims arising out of the Renter’s use of the rented premises. Renter is strongly advised to consult with Renter’s legal counsel and insurance agent to determine both liability exposure and insurance protection available to Renter when hosting the event for which the premises are being rented: this is true if alcoholic beverages are served or not served.

Compliance with Laws
No activities that violate federal, state, and local laws, ordinances, rules, regulations or in the opinion of the Board of Health shall be permitted on BALC premises. Renter shall be responsible to enforce this provision.

Collections
Renter shall make no collections, donations or solicitations of money or goods of any kind on BALC premises without first obtaining permission from the BALC.

Loud Disturbances
Excessive noise shall not be permitted on BALC property. It is the responsibility of Renter to control such things as music, speakers, boisterous participants, etc. Failure to control may result in the closing of the event.

Objectionable Persons
Being Alive and Priority Pharmacy reserves the right to eject or cause to be ejected from the premises of the BALC any objectionable person or persons. Neither Being Alive nor Priority Pharmacy nor any of its officers, agents or employees shall be liable to any Renter for any damages that may be sustained by such Renter subsequent to the exercise of such right by Being Alive management.

The term “objectionable persons” shall include those persons who by virtue of disorderly conduct, drunkenness, disruptive behavior, violation of Being Alive policy, make the normal and proper conducting of business or an event or the enjoyment of others of such event difficult or impossible for others.

Refusal to Rent
Being Alive and/or Priority Pharmacy shall refuse to rent or permit usage of BALC facilities for any event or activity if it determines that such event or activity or the anticipated attendees response to such event, activity or performance may cause damage or unusual risk of damage to BALC facilities or patrons.

Marketing
BALC shall not be obligated for the marketing or advertising of an event.
BALC does reserve the right to publicize eventS for the benefit of promotion of Being Alive, Being Alive Learning Center and/or Priority Pharmacy.

The Being Alive Learning Center at Priority Pharmacy name shall only be used as a location for the event. BALC, Priority Pharmacy and Being Alive logos may be used with prior consent only.

Technical Requirements
BALC will only be responsible for providing the technical equipment currently available at the BALC. (large LCD monitor and accompanying sound system, cables for Renter’s computer to be used for presentations on the LCD monitor, projection screen, PC’s and printers in private offices.)

Equipment and Supplies
Tables and chairs shall be furnished by the BALC to adequately seat the number of persons stated on this Agreement. Renter must supply cups, linens, china, flatware, etc., and is responsible for food, drinks, snacks, decoration, etc.

Only table decorations or free standing decorations are permitted (No candles). Decorations may not be hung on walls or ceilings. Glitter, confetti, or any other like material is not permitted. Renter is required to remove and properly dispose of all decorations.

Interruption or Cancellation of Event
BALC and Priority Pharmacy reserve the right to cancel, interrupt or terminate any event in the interest of public safety. Upon the return to normalcy the user shall be given sufficient time to finish the event without any additional charge. If it is impossible to complete the event, use shall be forfeited and a pro-rated charge or adjustment shall be made at the discretion of the BALC.
